Dispute Resolution (Litigation And ADR)
We identify potential problems surrounding legal issues in both civil and criminal matters, and take bold practical steps to represent Clients in Courts either by instituting or defending actions. If need be we proceed to appeal even to the Apex Court (Supreme Court) to represent our Clients. However, we realize the reality that litigation culminates in the “winner takes all” and the “loser loses all” situation, as part of our commitment to offer cost-effective services, we consider litigation as a last resort in dispute resolution, and thus explore other suitable alternative dispute resolution such as Arbitration, Mediation and Negotiation.
In this way we help Clients settle disputes in an optimal way and achieve major victories. These techniques include advance planning, negotiation, mediation, and arbitration.
With the high growth in trade and investment, the need for a neutral and efficient means of resolving commercial disputes is on the increase as parties in business transaction now recognize the advantages of resorting to a private ‘neutral’ tribunal, composed of one or more persons selected for expertise in the subject matter of the disputes. The Firm drives this practice with the active research and the representative work of members of the Firm who are members of the Chartered Institute of Arbitrators.
During the negotiation and preparation of dispute resolution causes in contracts, the Firm draws upon both its depth of experience and the constant interchange within the Firm of information on legal developments regarding international arbitration. With experience as Counsel and as Arbitrators, we are able to provide advice on the comparative advantages, including cost of conducting arbitrations under different sets of rules. This enables Clients to make informed decisions on pursuing arbitration or other forms of dispute resolution. Our competencies in the field include;
• Involvement at early stages of negotiation
• Setting up compliance programs for Clients
• Disputes pre-emption and Management
• Arbitration
• Mediation
